Welcome to Wadata Learn! These Terms of Service ("Terms") govern your use of the Wadata Learn platform โ€” Africa's premier learning management system for data skills. By creating an account or using our services, you agree to these Terms. Please read them carefully.

1 Acceptance of Terms

By accessing or using Wadata Learn, you agree to be bound by these Terms and our Privacy Notice.

  • If you do not agree, you may not use the platform.
  • Users aged 16-17 require parental or guardian consent.
  • We may update these Terms periodically. Continued use after updates means you accept the new Terms.

2 The Wadata Learn Platform

Wadata Learn is a learning management platform that provides:

Structured Courses

Curated learning paths with modules, videos, documents, and presentations covering data skills for the digital economy.

Assessments & Quizzes

Assignments and quizzes to test your knowledge and earn Continuous Learning Points (CLPs).

Certificates & Recognition

Earn verifiable certificates upon course completion to showcase your skills to employers.

Community & Discussions

Connect with fellow learners through discussion forums and community features.

3 User Accounts & Responsibilities

Account Creation

You must provide accurate, complete, and current information when registering. You are responsible for safeguarding your password and account credentials.

One Account Per Person

Each person may have only one account. Creating multiple accounts to manipulate progress, scores, or platform features is strictly prohibited.

Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, harassment, or unethical behavior.

4 Prohibited Conduct

To maintain a safe, ethical, and respectful learning community, you agree NOT to:

Academic Dishonesty

Cheat on assessments, submit plagiarized work, or share quiz answers

Harassment or Abuse

Harass, threaten, bully, or discriminate against other learners or staff

Content Piracy

Download, copy, redistribute, or sell course materials without authorization

Spam or Malware

Send spam, viruses, or attempt to hack or disrupt the platform

Violation Consequences:

Users who violate these rules may face account suspension, termination, revocation of certificates, and legal action where applicable.

5 Intellectual Property & Content

Platform Ownership:

Tectona Group Limited owns all rights to the Wadata Learn platform, software, branding, logos, and proprietary content. Users may not copy, modify, or reverse-engineer the platform's technology without permission.

Course Content:

All course materials (videos, documents, presentations, quizzes) are proprietary and licensed for personal, non-commercial use only. You may not redistribute, sell, or share course materials outside the platform.

Certificates:

Certificates are issued by Wadata Learn and remain the property of Tectona Group. Falsifying, altering, or forging certificates is strictly prohibited and may result in legal action.

6 Disclaimers & Limitations of Liability

Platform "As-Is":

Wadata Learn is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or that the platform will meet all your needs.

Employment Disclaimer:

Course completion and certificates do not guarantee employment. Wadata Learn provides education and skills training, but employment outcomes depend on many factors beyond our control.

Limitation of Liability:

To the fullest extent permitted by law, Wadata Learn is not liable for indirect, incidental, consequential, or punitive damages arising from platform use or reliance on course content.

Force Majeure:

Wadata Learn is not responsible for delays or failures caused by events beyond our control (e.g., natural disasters, government actions, internet outages, pandemics).

7 Termination & Account Closure

Your Right to Close:

You may close your account anytime from your settings. Upon closure, your learning progress and certificates will be retained for verification purposes.

Our Right to Terminate:

We may suspend or terminate your account for violating these Terms, academic dishonesty, or to comply with legal obligations.

Effect of Termination:

  • Your right to access the platform ends immediately
  • Certificates earned before termination remain valid and verifiable
  • Sections that should survive termination (e.g., IP rights, liability) remain in force

8 Dispute Resolution & Governing Law

Governing Law:

These Terms are governed by the laws of Kenya and international data protection regulations.

Dispute Resolution Process:

  1. Informal Resolution: Content jambo@wadata.africa to resolve disputes amicably.
  2. Mediation: If unresolved, disputes will be referred to mediation in Nairobi, Kenya.
  3. Arbitration: If mediation fails, disputes will be settled through binding arbitration under the Kenyan Arbitration Act.

9 Changes to These Terms

We may update these Terms to reflect platform changes or legal requirements. When we do:

  • We will post the updated Terms on this page with a new "Last Updated" date
  • For material changes, we will notify you via email or in-app notification
  • Continued use of the platform after updates constitutes acceptance of the new Terms

If you disagree with updated Terms, your remedy is to stop using Wadata Learn and close your account.
